Copyright (DMCA) Policy

Last Updated: October 1, 2024

Lyrics Gist (https://www.lyricsgist.com) respects the intellectual property rights of others and expects users of its services to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of responding to copyright infringement claims by promptly removing or disabling access to infringing content on our website when proper notification is provided to us.

This policy applies to all users of the website, and users are required to adhere to all applicable copyright laws.

1. Reporting Claims of Copyright Infringement

If you believe that any content on our website infringes upon your copyrighted material, you may submit a Notification of Claimed Infringement under the DMCA. To be valid, your notification must include all of the following information:

  • Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
  • Identification of the infringing material on our website, including the URL or other specific location where the material is located, so that we can locate and remove it.
  • Your contact information (e.g., your full name, address, phone number, and email address).
  • A statement that you have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in your notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
  • Your physical or electronic signature.

Once we receive your DMCA notification with the required information, we will investigate the claim and respond as appropriate, including removing the infringing material if the claim is found to be valid.

2. Designated Copyright Agent

To report copyright infringement claims under the DMCA, please contact our Designated Copyright Agent at dmca [at] lyricsgist dot com

Please note that this email address is only for DMCA notifications. Non-copyright-related inquiries sent to this address will not receive a response.

3. Counter-Notification Procedures

If your material was removed due to a copyright infringement claim, and you believe that the removal was a mistake or that you have the right to use the content, you may submit a Counter-Notification. To be valid, your Counter-Notification must include the following information:

  • Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your contact information, including your full name, address, phone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original notification or their agent.
  • Your physical or electronic signature.

Once we receive a valid counter-notification, we will forward it to the party who submitted the original DMCA claim. If we do not receive notice from the original claimant that they have filed a lawsuit within 10 business days, we may reinstate the removed content.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are repeat infringers. We may also limit access to the website and/or terminate the accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Misrepresentations

Please be advised that under the DMCA, any person who knowingly makes a false claim that material or activity is infringing may be subject to liability for damages (including costs and attorneys' fees). If you are unsure whether the material infringes your rights, you may want to seek legal advice before submitting a notification to us.

6. Standard Technical Measures

It is our policy to accommodate and not interfere with standard technical measures used by copyright owners to protect their materials.

7. Changes to this Policy

We reserve the right to make changes to this policy at any time. If we make changes, we will post the revised policy on this page and update the "Last Updated" date. You are encouraged to review this policy periodically for any updates.
